1. The Terms and Conditions

The following are the Terms and Conditions (the “Agreement”) which govern your access and use of our online platform through which MCT may be provided (collectively the “Platform”). The Platform may be provided or be accessible via multiple websites or applications whether owned and/or operated by us or by third parties.

By accessing or using the Platform, you are entering into this Agreement. You should read this Agreement carefully before starting to use the Platform. If you do not agree to be bound to any term of this Agreement, you must not access the Platform.

2. The service

The Platform may be used to connect you with a MCT therapist who will provide services to you through the Platform (“MCT Services”).

MCT Online require every therapist providing services on the Platform to be an accredited, trained, and experienced licensed psychologist or a licensed professional counselor (LPC) who is also trained by the MCT Institute® and holds the title of MCT-Institute registered therapist™. The therapists are independent providers who are neither our employees nor agents nor representatives. The Platform’s role is limited to enabling the MCT Services while the therapists are themselves responsible for the provision of the services on the Platform. If you feel the MCT Service provided by the therapist does not fit your needs or expectations, you may change to a different therapist through the Platform.

While we hope the MCT Services are beneficial to you, you understand, agree and acknowledge that they may not be the appropriate solution for everyone’s needs and that they may not be appropriate for every particular situation and/or may not be a complete substitute for a face-to-face examination and/or care in every particular situation. The services on this Platform are not appropriate for handling acute psychiatric emergencies, such as suicide attempts or self-harming behaviours or medical conditions that need immediate medical care. In these instances, medical health care should be sought and contact made with your medical doctor or hospital emergency services.
Please note that the Platform is not designed to provide diagnostic assessment or personality evaluations, and such requests will be declined by the therapists.

3. Privacy and Storing of information

Protecting and safeguarding any information you provide through the Platform is of utmost importance to us and we will follow the rules of confidentiality the health care system uses. We will not collect information about your personal life on the Platform, but we will store limited information about other health related issues, such as current level of emotional distress during the consultations and until you no longer use the Platform. The Information will be stored on our secured servers in EU and all information will be deleted after 12 months when without any user activity. We delete all information except when we are required by law to keep it; e.g billing information for taxation purposes, that must be stored for at least 10 years.

4. Disclaimer of Warranty and Limitation of Liability

MCT Online is not responsible for any actions or claims of misconduct or harm against the MCT services or the therapist. The Platform is provided as a medium for clients to seek MCT services and is provided as a vehicle to match the client and an authorized MCT therapist. The use of this Platform is at the client’s risk.

5. Legal age, conduct and commitments

In order to use the Platform you must be at least 16 years of age, and legally able to consent to receive MCT Services. You hereby confirm and agree that all the information that you provided in or through the Platform, and the information that you will provide in or through the Platform in the future, is accurate, true, current and complete. Furthermore, you agree that you will make sure to maintain and update this information so it will continue to be accurate, current and complete.

6. Interruptions or changes to the Platform

MCT Online™ may modify or discontinue the Platform, any part of the Platform or the use of the Platform, whether to all clients or to you specifically, at any time with or without notice to you. The Platform depends on various factors such as software, hardware and tools, either our own or those owned and/or operated by our contractors and suppliers. While we make commercially reasonable efforts to ensure the Platform’s reliability and accessibility, you understand and agree that no platform can be 100% reliable and accessible and so we cannot guarantee that access to the Platform will be uninterrupted or that it will be accessible, consistent, timely or error-free at all times. However, if any interruptions happen that interfere with the therapy services, the session will be refunded or a new session will be set-up without any additional cost.

7. Collection and usage of your information

We collect and store the following information about the client:

  • Name, date of birth, sex, e-mail address
  • Registration, account and sign-up information (when you sign-up and for how long)
  • Payment information and number of sessions paid for.
  • Information about level of symptoms of anxiety (2 questions), depression (2 questions), information about risk (suicidal plans, ideation), and information about self-regulation of thoughts (4 questions).
    The information will be collected in order to assess the current mental health and to evaluate any potential risks of the client in the consultation. We collect this information on the Platform with the client’s consent and agreement, before any consultation can start.

The information will be stored secured on our servers and information that we have which is not required by law, will be deleted after 12 months of inactivity. The data of mental health will be anonymised and transferred to a research database, but with no linkage to the clients’ personal id, or other information that may disclose the identity of the client.

By entering and using the Platform you agree to these terms and conditions, and the privacy policy we have stated in this document.

Complaints and contacts

Complaints about the service, payments or lack of information should be directed at MCT Online™ at support@mct-online.org and this will be handled immediately.
Complains about the data handling or protection you should contact our data protection officer at support@mct-online.org.

If you are still not satisfied with our response, you can move on and complain to the Data Protection Authority. We can assist you in order to obtain contact with them.

If you have any questions about our privacy policy please contact us at support@mct-online.org. The storage and information to our users of the platform is in accordance with the EU-regulations (GDPR, 2018).
